Updates....

I know this is alot late but things have been rough lately. First off I would like to thank everyone who wrote me a letter of support or donated some cash to help out. I recieved over 1500 letters of support from you guys in just those couple days. I replied to as many as I could before I had to move.

About my headaches. They did some blood work and took another ct scan a few days later. They said it wasn't an aneurysm but were still unsure what it was. They put me on a beta blocker and told me to take it easy. Eventually it quit hurting all the time and now every now and then it'll hurt but never as bad as it was before.

As all of you can see the website is back up. Only lost a few days of the database. I was able to recover a few day old backup off of the database that was on the second drive in the server. and I had a few week old copy of the source code. After redoing my changes I had made to the code I was able to get the site backup up on a new more relialable server.

Like I mentioned a couple minutes ago I had to move out of the place I was staying. I ended up moving back home with my parents. Me and my fiance are currently looking for an apartment. Just trying to get back on track financially. (Living at home BLOWS). Oh while I'm talking about moving lemme tell ya what my jackass roommate Brian did to me. In the middle of me making trips once a day to move all of my personal belongings. Brian busts into my room and steals my: 200mw high power pcmcia wireless card, Linksys 4 port dsl/cable router, Linksys wrt54g wireless router/ap, Tv(27"), Walkman(mp3), ps2, extra computer (celeron 600), 17" monitor, canon A80 camera w/512 cf card, unopened ceiling fan, cordless dremel + accessories, misc cd's and dvd's, plus alot of misc shit thats too long to list here. oh plus the cargo cover for the back of my jeep. Like what is that going to fit lol When I confronted him about my missing items he stated that he was going to return them to me the following day. That was over 2 weeks ago. He will not answer my phone calls, hangs up when I say something if I call from a number he dosent recognise, and wont answer my IM's or emails. I'm debating whether or not to take him to court or let karma deal with him. I never thought my FRIEND would do something like this to me.

I'm still looking for people to help with the building a new website from scratch. I recieved alot of emails when the site was down of people offering to help. I think I replied to all of them asking them to email if they are still interested. Also If anyone new is interested in joining a team of people to help write a whole new vcdquality.com please please email me and goto http://new.vcdquality.com/forum and read my ideas and post ideas of your own.

Okay this is getting rather long and its late so I'm gonna goto bed. Hope to see your ideas for the new site at http://new.vcdquality.com/forum

Ohh we could also use some updaters. If your interested in helping update the site please post why you should be an updater on http://new.vcdqualtiy.com/forum

I'm going to make a form to fill out if you donated while the site was down and would like popups/ads removed.

Thanks guys.
Gerard aka X69

PS We could also use some legal advice ie someone who could make us some disclaimers and other legal notices.

He's likely sold off some of your items.

Sue, sue, sue.

That's too much stuff just to let go.

I think small claims in < 5 grand.

::Edit::
[not asking anyone in particular]
BTW, where are my posts? I could have sworn last night I was in the early 300s, not that I'm worried about the count, however, what of all the ground shakingly important things I say? Someone might miss something that would have changed their life forever. Ah, well.

::Edit (again)::
I was talking about a drop in posts since last night. I didn't reply with another post so that I wouldn't go off topic, which I already did.

It is sad that your 'friend' would do that, but when it comes down to it, its theft, and he is obviously avoiding giving them back. So call the police and get it dealt with

As for everything else, i hope things look up for you and your fiance and good luck finding a new apartment.

lolobo21, in regard to the lost posts, its a global thing i have noticed the drop some small some larger on a lot of users. As X69's post stated some of the db was lost and a backup had to be used. This would mean posts between that point in time would be lost.

A few things you may want to look into about all your stuff.

1. Check with your home insurance policy, it may cover theft (and since he walked into your room to steal the belongings, it can be considered burglary).
2. As lolobo and om3n said, you could also deal with it legally. If insurance covers it, you may not get punitive monetary damages, but you could get some for unnecessary stress etc. etc.
3. Hire two really large guys and have them "scare" him (just make sure they don't leave any bruises heh).

As per liability issues, anything that is posted on this site, you are, unfortunately liable for. As you probably already know, speaking about general releases is completely fine, as long as you never mention their whereabouts. Thus, disclaimers regarding content on the site are merely superficial and will not help you in court. However, legally you should dictate that you have the right to alter content and whether you will or will not publish user information. That's a _basic_ disclaimer right there.

I hope all goes well with retrieving your belongings. And that your "friend" gets whatever he deserves.

1 More Liability Issue

No disclaimer at all will get you out of displaying a screenshot from a release. That is 100% a copyright infringement act, as the production company owns complete rights even after it is released on DVD.

X69 on Judge Judy or Judge Joe Brown, now wouldn't that be the shit?

Sounds like he would have Renters Insurance if anything, and most Renters policies do not cover roommate theft. Theft is a criminal act, and in this case X69 would only be able to file a civil suit (ie. small claims court). Take him to court, they will order him to either return the items or reimburse you. Make sure you have receipts, pictures, witnesses, etc. that can show you own the property and that he has possession of it.

Unhappy to your "friend"

watch godfather part 2, find luca bracis brother and send him to this guy.

don´t deal with him on a legal base, ´cause when it comes to betraying friends, things have to be handled "honorably".

all the best for you and your fiance.

vcdquality is great and if you have to take out the screenshots to save yourself from being sued - just do it - everyone will understand!
