There is a standard for MPEG-4, and all hardware players support the Simple Profile (SP) within that standard.
The XviD encoder can be configured to generate Simple Profile*, however usually Advanced Simple Profile (ASP) is used (this includes for Quarterpel, GMC, etc.). Some hardware players can cope with this, but AFAIK there is no player (yet) that supports all the feaures of ASP.

I don't know, it's just one of those inconsistencies in the scene rules, like SVCDs that have audio bitrates other than 224kbps are nuked because of reported incompatibilities with some standalones, even though an SVCD with 192kbps conforms to standards and will play on 99% of players. On the other hand, some groups release VCDs with non-VCD-standard video streams (OBUS, MPT) and they are left alone!
*(Up until recently, even video encoded to Simple Profile was not 100% guarateed to be MPEG-4 compliant ,due to a limitation in the codec. I believe this is now fixed since XviD 1.0)
