Sample jpg images + copyright.

I recently uploaded a few screen grabs/sample images for a couple of porn flicks and today I got an email from my host saying I was hosting copyrighted material (naming the files) and saying I was in breech of contract.

To advoid the fuss I deleted the images quickly and let them know I had done so, but my question is how does VCDQualiy provide jpg samples on such a large scale without getting in trouble (as far as i know), are my host wrong about a couple of frames of a video being copyrighted?

The way I'm looking at it is a few frames of a video in a montage is more an piece of art rather than copyright infrindgement but whats the legal standing on this.

Try using a host that isn't a total wuss.

Bitter, miserable twat.

X69 has received C&D letters in the past (look through some of the old posts in the News forum). Although I think the main problem was thick lawyers who thought the site offered full movie downloads.

For JPGs, you could argue fair use, i.e. a single frame from a 2-hour movie is not a substantial portion of the work, and does not affect box office or DVD sales. But it's much easier to just remove the images than try that defence in court.

Yeah, it depends on how you're using them... We're ok because we're pretty much announcing "news" so the screenshots can be justified. I guess if the only purpose was for entertainment (for example) then you probably are infringing their rights. The law is so fucking messy though, who knows?
